BROWNSVILLE, TEXAS · LANDLORD GUIDE

Brownsville rental registration rules: yearly multifamily licence, $50 STR permit, one-hour contact

Brownsville registers buildings of four or more units through its Multi-Family Housing Inspection Program — $50 plus $12 a unit, inspected before the licence, every year — and, since November 2024, every short-term rental through a permit that demands a local contact answering in person within an hour, a permit number in every listing and prior hotel-tax registration. A house let for a month or more is not registered.

Two registers, two thresholds. The first counts units: “The inspection program requires rental property owners to register their units with the City of Brownsville and undergo a yearly inspection,” at “$50 plus $12 per unit,” and “mobile home parks, duplexes and single family residences are not included” — the programme came in with the city’s adoption of a property maintenance code in December 2012 (Multi-Family Housing Inspection Program). The second counts nights: Ordinance 2024-1760 requires a registration and permit before any dwelling is advertised or rented for “not more than 30 days” (Chapter 94, Article IV-A). Read in September 2026, nothing in either register touches a single house or a duplex let for a year.

Multifamily: register, inspect, renew

The Housing Rental Registration Application goes to the Building Inspection and Permitting Department at City Plaza, 1034 E. Levee Street, with supporting documents (application); “inspections must be conducted prior to issuance of license,” and the licence is annual (City of Brownsville). Because the city’s own site could not be read from outside the United States for this guide, the renewal month, the inspection checklist and the penalty for operating unregistered are recorded among the items to verify rather than stated here; the fee and the four-unit threshold come from the city’s programme page. Budget the inspection into the turnover calendar: a building that fails on the day the licence lapses cannot lawfully let its units until it passes.

Short-term rentals: what the 2024 ordinance requires

  1. Before advertising: apply to the city; "It shall be unlawful … to rent to an occupant, or offer to rent to an occupant, any short-term rental without a valid short-term rental registration and permit" (§94-135(a)).
  2. On the application: the owner or operator’s contact details; "the name, address, email, and 24-hour telephone number of the local contact person" who is "available 24 hours per day, 7 days per week" and responds "in person within one hour to complaints" (§94-135(c)).
  3. Also on the application: the bedroom count and occupancy limit, and "the property ID number as listed with the Cameron County Appraisal District."
  4. Before approval: registration with the city to pay hotel occupancy tax — 7% under §94-117 — because the permit is not issued without it (§94-135(f)).
  5. Fee: $50 on the December 2024 Master Fee Schedule (Master Fee Schedule).
  6. After issue: the permit number "must be included in all Listings, whether online, in print, or in some other medium"; changes notified in writing within 30 days; permit valid one year, renewable within 30 days after expiry (§94-135(h)–(k)).

Two provisions deserve a second reading. Any owner “delinquent and/or owing the fees and/or taxes to the City, including but not limited to hotel occupancy tax and utility service fees, will be prohibited from registering” — an unpaid BPUB bill blocks the permit. And “any Listing … promoting the availability of a property within the City for rent for a period of less than 30 days, shall constitute prima facie evidence of the property’s use as a short-term rental” (§§94-135, 94-136): the advertisement proves the offence.

Enforcement: graduated, then revoked

An offence is a Class C misdemeanour with graduated penalties: a warning for the first violation, a fine of up to $250 for a second within a year, up to $500 for subsequent ones, each day a separate violation — and “the STR permit is subject to revocation with the 3rd violation in any one permit year” (§94-136). Occupants can be cited as well as owners and operators.

The long-term lease and the one-hour contact

A tenant who lists a Brownsville house for weekend stays makes the owner an unregistered operator — with the listing as evidence — and, if a permit is later sought, the owner’s unpaid utility or tax balance can block it. The lease should prohibit stays of 30 days or less, define guests paying the tenant as such a stay, and make a breach a default. If the owner wants the income, the owner registers, names a contact who can be at the door within the hour, and files the tax monthly. The Brownsville lease guide has the clause; the Brownsville maintenance guide has the inspection.

What changes in Brownsville

  • Four units is the registration threshold; duplexes and houses let long-term file nothing.
  • $50 plus $12 a unit, and an inspection before the licence, every year.
  • A 2024 STR permit ($50) with a one-hour, in-person local contact and the permit number in every listing.
  • Unpaid hotel tax or BPUB bills block an STR permit; a listing is prima facie evidence.
  • Warning, $250, $500, then revocation at the third violation in a permit year.
