Austin’s registration rule is conditional. A landlord who keeps the property in compliance never registers it; a landlord who lets two notices of violation go uncorrected within 24 months, or collects two citations in that period, must register for at least five years. Short stays are a separate licensing regime. Both are in Title 4 of the City Code, read on Municode in September 2026 and current through August 26, 2026.
Chapter 4-14, Article 1: registration of rental property
Section 4-14-3 requires a rental registration “for multi-family rental property or single-family rental property occupied by a non-owner” when one of two conditions is met: two or more separate notices of violation are issued for the same property within a consecutive 24-month period and the owner fails to correct them, or two or more citations are issued within 24 months. The violations must relate to Chapter 25-12 (Technical Codes), Chapter 10-5, Article 2 (Sanitary Condition of Real Property), Chapter 10-7 (Pools and Spas) or Section 25-11-32 (Permit Required). Owner-occupied units are excluded. Once triggered, the code official gives written notice, may allow up to 14 days to register, and registration is per property and non-transferable; a change of ownership requires a new application within 30 days unless the property is brought into compliance within 90 days of the sale. The article sets the registration period at a minimum of five years, §4-14-32 makes the fee annual and set by separate ordinance, §4-14-33 requires the registration to be displayed, and §4-14-53 makes each day of violation a separate offense with a fine of up to $2,000.
How to stay off the list
The trigger is uncorrected violations, so the defence is a documented correction habit. When a notice of violation arrives, correct it within the period stated, photograph the correction, and keep the city’s closure confirmation. A tenant reporting route that reaches the landlord before it reaches 311 helps: the lease should name the repair contact and the emergency number, and the welcome sheet should repeat them. The Austin inspection and maintenance guide sets out the workflow.
Chapter 4-23: short-term rentals
Chapter 4-23, adopted by Ordinance 20250227-040 in March 2025 and amended by Ordinance 20250911-012 with provisions effective October 1, 2025 and July 1, 2026, defines a short-term rental as “the rental of a housing unit or a portion of a housing unit for periods of less than 30 consecutive days,” excluding a short extension of an existing 30-day-plus lease and a rental between the parties to a sale. An operator must hold a license; the operator must own or lease the unit (§4-23-31); platforms must delist unlicensed units on notice (§4-23-23) and may not accept a fee to facilitate a booking for a unit without a valid license (§4-23-25). Appeals of a denial or revocation go to a hearing officer within 10 days. The chapter sets the framework; the current fee schedule is adopted separately and should be checked with Development Services before applying.
What the ordinary Austin landlord records
| Program | Trigger or scope | Cost | Duration | Source |
|---|---|---|---|---|
| Rental registration (Ch. 4-14, Art. 1) | 2+ uncorrected notices of violation or 2+ citations in 24 months; non-owner-occupied rentals | Annual fee set by separate ordinance; fines up to $2,000 per day for violations | At least 5 years | Ch. 4-14 |
| Short-term rental operator’s license (Ch. 4-23) | Any rental under 30 consecutive days | Fee set separately; platforms barred from booking unlicensed units | Per license term | Ch. 4-23 |
| Long-term rental with no violations | — | None | — | Austin City Code |
- A dated note that no registration applies while the property has fewer than two uncorrected violations or citations in 24 months.
- Every notice of violation with its correction date and the city’s closure — the 24-month counter is yours to keep.
- For any stay under 30 days: the operator’s license number, or a subletting clause forbidding such stays.
- For a landlord with five or more dwellings: the notice of proposed eviction form required by Chapter 4-14, Article 2, kept ready.
What changes in Austin
- Registration is triggered by conduct, not by renting: two uncorrected violations or two citations in 24 months.
- Once triggered, registration lasts at least five years and the property must display it.
- Short-term rentals are licensed under a 2025 chapter that makes platforms delist unlicensed units.
- Owner-occupied units are outside the registration article entirely.
Frequently asked questions
Does Austin require rental registration?
Only for repeat offenders: Chapter 4-14, Article 1 requires registration after two uncorrected notices of violation or two citations within 24 months. A compliant rental is never registered.
How long does an Austin rental registration last?
At least five years from registration, with an annual fee set by separate ordinance and a display requirement (Chapter 4-14, Article 1).
What is the penalty for not registering when Austin requires it?
Each day is a separate offense punishable by a fine of up to $2,000 (§4-14-53); for fines of $500 or less no culpable mental state need be proved.
Do I need a license to rent my Austin house on a booking platform?
Yes, for stays under 30 consecutive days: Chapter 4-23 requires an operator’s license, and platforms may not take bookings for a unit without one.
